These terms are the agreement between you and Amelia Frost (the "publisher") for the use of the Bareya Evo mobile application. By installing or using the app you accept them. If you do not agree, do not use the app.
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Bareya Evo on devices you own or control, for the purpose of recording and managing your own transport operations. You may use the app for a sole-trader business or within a company, subject to these terms. You may not copy, modify, reverse-engineer, decompile, resell or redistribute the app except where the law expressly allows it.
You must be at least 16 years old and legally able to enter into a contract. If you use the app on behalf of a business, you confirm you have authority to bind that business, and "you" includes it.
Everything you enter, including loads, cargo photos, customer contacts, fleet units and templates, remains yours. The app stores it on your device and we do not receive it (see the Privacy Policy). You are responsible for:
The app formats dates, converts units (kilograms and tonnes, cubic metres), computes distances and totals invoiced amounts to help you keep a tidy logbook. These are convenience calculations based on the values you type. They are not accounting, tax or legal advice, and they do not replace your official invoices, weighbridge tickets, tachograph or statutory records.
Route maps are rendered by your device's mapping service and are subject to that provider's terms. Distances shown are estimates and may differ from the distance actually driven, from toll-road records or from odometer readings. Do not interact with the app while driving.
You agree not to use the app to store unlawful content, to harass or defraud any person, to infringe others' rights, or to interfere with the app's operation or the platforms it runs on. You must comply with the app-store terms of the store you downloaded from.
We may release updates that add, change or remove features. Some updates may be required for the app to keep working on newer operating systems. We may discontinue the app at any time; because your data lives on your device, discontinuation does not delete your records, but we cannot guarantee future compatibility.
The app, its name "Bareya Evo", its design, icons and code are owned by the publisher or licensed to it and are protected by copyright and trademark law. Nothing in these terms transfers any of those rights to you. Your own content is not affected by this clause.
The app is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not promise the app will be error-free, uninterrupted or compatible with every device.
To the extent permitted by law, the publisher is not liable for indirect, incidental, special or consequential loss, including lost profit, lost cargo, lost business, missed deliveries, penalties, or loss of data, arising from use of or inability to use the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim, or the equivalent of 50 US dollars if you paid nothing. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
You may stop using the app at any time by deleting it. We may end your licence if you materially breach these terms. Clauses 3, 4, 8, 9, 10 and 12 survive termination.
